We make every effort to accurately describe and photograph our artwork. However, variations in color and texture may occur due to screen settings.
Confidentiality
We do not share customer information with external third parties.
Intellectual property
This policy governs the intellectual property rights related to artwork sold through Geller Gallery.
Artist Retains Copyright: The Artist retains all copyrights and intellectual property rights in the artwork, including the right to reproduce, create derivative works, or display the artwork, even after the original physical piece has been sold.
Purchaser's Rights: The Purchaser acquires the physical artwork itself (the material object). They do not acquire the right to reproduce, copy, publish, or commercially exploit the artwork without the Artist's prior written permission.
Gallery's Use: Geller Gallery retains the right to use images of sold artwork for promotional, marketing, and archival purposes (e.g., on our website, social media, or in catalogs).
No Unauthorized Use: Any unauthorized use, reproduction, or distribution of the artwork's image or concept is a violation of copyright law and will be pursued accordingly.
Use of Website Content: Website users/visitors are prohibited from downloading, reproducing, or using any images, text, logos, or other content from gellergallery.com for any commercial purpose without explicit written permission.
Limitation of liability
Scope: By purchasing artwork from Geller Gallery, you agree that our total liability, including for any errors, defects, or failure to deliver, is strictly limited to the total amount you paid for the specific artwork in question.
Exclusions: We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits or business interruption.
Insured Shipping and Risk of Loss:
Insurance Coverage: All artwork is shipped with insurance covering its full purchase price against loss or damage during transit.
Remedy: Our liability for shipping incidents is limited to facilitating the insurance claim and either replacing the work (if possible) or refunding the Purchaser the amount recovered from the claim.

Payment refund
All Sales Are Final: Please be aware that all purchases of artwork are final. We do not accept returns, exchanges, or offer refunds once a purchase has been completed, except in the specific case of insured transit damage.

Resolving disputes
Informal Resolution: You agree to first contact Geller Gallery at admin@gellergallery.com to attempt to resolve any dispute, claim, or controversy informally. We aim to resolve all issues amicably within 14 days.
Mandatory Arbitration: If the dispute cannot be resolved informally, you and Geller Gallery agree to resolve the claim through final and binding arbitration in Las Vegas, Nevada, USA. Class arbitrations and class actions are strictly prohibited.
Governing Law: This policy is governed by the laws of Nevada, USA.
Right to terminate

2. Gallery's Right to Terminate
Geller Gallery reserves the right to terminate any transaction and issue a full refund if:
Payment Fails (e.g., payment cannot be verified within 72 hours.
Errors Occur (e.g., the artwork is unavailable, or there is a technical pricing error).

Shipping Payment Failure
The purchaser fails to provide full payment for packing, insurance and shipping costs.
3. Refund Guarantee
If the Gallery terminates a transaction, the Buyer will be notified immediately, and a full refund will be processed within 14 business days. Gallery will refund through same method that initial payment was collected. Gallery will in good faith make every attempt to refund customer in a prompt and timely manner.
Shipping and Damage Policy
Packaging: Every piece of artwork is professionally packaged to ensure its safe journey. The purchaser is required to pay for packing, insurance and shipping costs.
Shipping Insurance: All shipments are insured for their full value against loss or damage during transit. The value of insurance cannot and will not exceed the value of the initial purchase price.
Damage in Transit: In the unlikely event that your artwork arrives damaged, you must:
Notify us immediately (within 48 hours of delivery).
Retain all original packaging materials (including the box, packing peanuts, tape, etc.). These are required for the insurance claim process.
Provide clear photographic evidence of the damaged artwork and the damaged packaging.
Processing Claims: We will handle the insurance claim on your behalf. Please note that the successful resolution of a claim is dependent on your cooperation and timely provision of the required evidence. Refunds for transit damage will only be issued upon the successful payout of the insurance claim.
We encourage you to inspect the images, read the descriptions thoroughly, and contact us with any questions about a piece before finalizing your order.
Warranty and warranty disclaimers
1. Warranty of Title
Geller Galley warrants only that we have the legal right to sell the artwork, the artist is the creator of the work, and the work is free from any liens or encumbrances. This is the only warranty provided.
2. General Disclaimer
All artwork is sold "as is, where is."
By purchasing, you accept the work's condition, including all minor imperfections, variations, or signs of age.
We make no other warranties, whether express or implied. This includes, but is not limited to; the warranties of fitness for a particular purpose or merchantability.
3. Liability and Authentication
Statements regarding provenance, artistic significance, or potential value are opinions only and do not constitute a guarantee of future value or authenticity.
We are not liable for any damage or deterioration resulting from improper handling, care, or environmental factors (e.g., light exposure, humidity) once the artwork is in the Purchaser's possession.
